Damages Are Not the Last Chapter

Liability gets the attention.

Damages often get the spreadsheet.

That is backwards.

A claimant can prove everything that happened and still have a disappointing arbitration if it cannot prove what the consequences were.

Causation, valuation, mitigation and the assumptions buried inside an expert model are not cleanup work after the legal case is finished.

They are the case.

Sometimes the most important question is not:

"Can we win?"

It is:

"What exactly do we win if we do?"
